DMCA Notice and Takedown Policy
At InkWize, we respect the intellectual property rights of others and are committed to helping protect your copyrighted work. The following is our process for handling allegations of intellectual property infringement.
A. Reporting Alleged Infringements
If you believe that content available on or through the InkWize website (referred to as "Content") infringes upon your intellectual property rights, please notify our Designated Agent by providing the following information:
Identification of the copyrighted work or intellectual property you claim has been infringed, including registration number(s) if applicable.
Detailed description of the alleged infringement and its specific location on our website, enabling us to locate the material.
Your contact details including full name, mailing address, telephone number, and email address.
A statement of good faith belief that the use of the material in the manner complained of is not authorized by the intellectual property owner, its agent, or the law.
A statement under penalty of perjury that the information in the notification is accurate, and that you are the intellectual property owner or authorized to act on the owner’s behalf.
Your electronic or physical signature.
B. Handling of Infringement Notices
Upon receipt of a valid infringement notice, InkWize will promptly remove or disable access to the infringing Content and take reasonable steps to notify the content provider who may respond with a counter-notice as described below.
C. Counter-Notice Procedures
If you receive a notification from InkWize that the Content has been removed due to an infringement notice and you believe this is due to a mistake or misidentification, you may submit a counter-notice with the following information:
Identification of the Content that was removed and its previous location.
A statement under penalty of perjury that you believe the Content was removed by mistake or misidentification.
Your contact information, including full name, address, telephone number, and email address.
1.A statement consenting to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if outside the U.S., for any judicial district in which InkWize may be found.
2.Your electronic or physical signature.
Upon receipt of a counter-notice, InkWize will forward it to the party who submitted the original infringement notice. If we do not receive notification within 10 business days that the original notifier is seeking a court order to prevent further infringement of the Content, we may reinstate the Content on the site.
D. Liability for Misrepresentation
Under Section 512(f) of the DMCA, individuals who knowingly and materially misrepresent that material or activity is infringing may be subject to liability for damages, including costs and attorneys’ fees.
